Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a legal agreement between you and Phoenix Orien LLC, a Wyoming limited liability company ("HIIRD," "we," "us," or "our"), the company behind the HIIRD mobile application. By downloading, installing, or using the HIIRD mobile application ("App") or visiting our website at hiird.app ("Site"), you agree to be bound by these Terms. If you do not agree, do not use the App or Site.

2. Eligibility

You must be at least 13 years old to use HIIRD. If you are between 13 and 18 years old, you may only use HIIRD with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

HIIRD is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have collected information from a child under 13, we will delete it promptly. If you believe a child under 13 has provided us with personal information, please contact us at hello@hiird.app.

3. Account Registration

To use HIIRD, you must create an account by providing your email address. During onboarding, you will also provide your name and select your experience level. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to keep it updated.

You may not share your account credentials with any other person or allow another person to access your account. You must notify us immediately at hello@hiird.app if you suspect unauthorized access to your account.

You may upload documents such as resumes and job descriptions to personalize your practice sessions. By uploading documents, you represent and warrant that:

You retain full ownership of all documents you upload. You grant HIIRD a limited, non-exclusive license to process your uploaded documents solely for the purpose of providing and improving the interview coaching service. We do not share your uploaded documents in identifiable form with any third party. Personally identifiable information is stripped from document content before it is processed by our AI systems.

8. Subscriptions, Payments, and Refunds

HIIRD offers a free first session. Additional access requires a paid subscription or a per-session purchase. Available plans include:

All payments are processed through Apple's In-App Purchase system. By subscribing, you agree to Apple's payment terms. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage or cancel your subscription through your Apple ID account settings.

Refunds are handled by Apple in accordance with Apple's refund policy. HIIRD does not process payments directly and cannot issue refunds. To request a refund, contact Apple Support or use the "Report a Problem" page at reportaproblem.apple.com.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms.

10. Intellectual Property

The HIIRD name, logo, branding, App design, content, features, and underlying technology are the property of Phoenix Orien LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our prior written consent.

Your use of the App does not grant you any ownership rights in HIIRD or its content. AI-generated feedback and debrief content provided to you during your use of the App is licensed to you for personal, non-commercial use only.

11. User Content

You retain ownership of all content you provide to HIIRD, including your spoken responses, uploaded documents, and profile information ("User Content"). You grant us a limited license to use your User Content solely to provide and improve the service.

We do not claim ownership of your User Content. We do not use your User Content to train AI models, and our AI service provider's commercial terms prohibit them from training models on data submitted through their API. We do not sell, license, or share your User Content with third parties for their own purposes.

12. Disclaimer of Warranties

HIIRD IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any AI-generated content, feedback, or scoring provided through the App.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PHOENIX ORIEN LLC AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless Phoenix Orien LLC and its officers, directors, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

You may stop using HIIRD and delete your account at any time by contacting us at hello@hiird.app. We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including Sections 10 through 14 and 16 through 18.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

17. Dispute Resolution

Before filing any legal claim, you agree to first contact us at hello@hiird.app and attempt to resolve the dispute informally for at least thirty (30) days. If we cannot resolve the dispute informally, either party may pursue resolution through the courts as described in Section 16.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice in the App. Your continued use of HIIRD after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
